Terms of Service

1. Acceptance of Terms

By accessing or using DeviceCompass ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms. If you do not agree, do not use the Service.

2. Description of Service

DeviceCompass is a software-as-a-service platform that assists users in navigating medical device regulatory classification frameworks. The Service provides guided decision trees, AI-assisted device description interpretation, risk scoring, and PDF report generation across multiple regulatory jurisdictions.

3. Accounts

To access certain features you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password and account credentials
  • Promptly notify us of any unauthorised use of your account
  • Accept responsibility for all activity that occurs under your account

4. Subscriptions & Billing

Paid features are available through subscription plans. By subscribing, you agree to the following:

  • Subscriptions are billed monthly or annually as selected at checkout
  • Payments are processed securely by Stripe — we do not store payment card details
  • Unused classification credits do not roll over between billing periods
  • You may cancel your subscription at any time — access continues until the end of the current billing period
  • We reserve the right to change pricing with 30 days' prior notice
  • Refunds are handled on a case-by-case basis at our discretion

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulations
  • Attempt to gain unauthorised access to the Service, other accounts, or related systems
  • Interfere with or disrupt the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated means (bots, scrapers) to access the Service without prior written consent
  • Resell or redistribute access to the Service without our written agreement

6. Intellectual Property

The Service, including its software, design, content, and documentation, is owned by DeviceCompass and protected by intellectual property laws. You retain ownership of your data (device descriptions, classification inputs). By using the Service, you grant us a limited licence to process your data solely to provide the Service.

Classification reports generated by the Service may be used freely within your organisation. The underlying decision tree logic, scoring models, and software remain our intellectual property.

7. Not Regulatory Advice

This is an important clause — please read it carefully.

DeviceCompass is an informational and decision-support tool. It does not provide legal, regulatory, or professional advice. Classification outputs are guidance only and do not constitute official regulatory determinations. You are solely responsible for ensuring your medical device complies with all applicable regulations. Always consult qualified regulatory affairs professionals and the relevant Competent Authority or regulatory body for definitive classification decisions.

8. Limitation of Liability

To the maximum extent permitted by applicable law, DeviceCompass and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service — even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that classification outputs will be accurate or complete.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Limitation of Liability, Disclaimer, and Governing Law) shall survive.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Oslo, Norway.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a notice in the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
